This tool turns a list of pending faults into a dated repair request letter, sorting each fault into the landlord's column or the tenant's column using the Second Schedule of the Model Tenancy Act, 2021. It records how long each item has been outstanding, sets a deadline for the landlord to act, and states the rent-deduction ceiling of fifty per cent of a month's rent that Section 15 of the Act allows when a landlord neglects repairs he is liable for. Under the Second Schedule of the Model Tenancy Act, 2021 the landlord handles whitewashing walls and painting doors and windows, changing and plumbing of pipes, internal and external electrical wiring, structural repairs not caused by the tenant, and common facilities such as lifts, water pumps and staircase lighting.
The tenant's list in the same Schedule covers drain cleaning, switch and socket repairs, kitchen fixture repairs, replacing broken glass panels in windows and doors, and upkeep of gardens and open spaces. Damage caused by the tenant is also the tenant's to fix.
Section 15 of the Model Tenancy Act, 2021 lets a tenant carry out repairs the landlord neglected after notice and deduct the cost from rent, but the deduction cannot exceed fifty per cent of the rent payable for that month. Give written notice first and keep the bills.
