ITR-3 is for individuals and HUFs who have income from profits and gains of business or profession. That includes proprietors, professionals who do not use presumptive taxation, partners in a firm receiving remuneration, interest or share of profit, and traders whose F&O or intraday activity is treated as business income.
Yes, if you are a resident, your total income is up to ₹50 lakh, and you declare income presumptively under Section 44ADA. ITR-4 is closed to you if you are a company director, hold unlisted equity shares, own foreign assets, have more than one house property, or carry forward losses.
F&O and intraday trading are treated as business income rather than capital gains, so they cannot go in ITR-1 or ITR-2. Intraday equity trading is speculative business income and cannot be declared under Section 44AD, which leaves ITR-3 as the form.
The Income Tax Department can treat the return as defective under Section 139(9) and issue a notice giving you 15 days to correct it. If you do not respond in time the return can be treated as never filed, so choosing the right form up front matters.
