Whatever the tenancy agreement says — one month is the usual residential term and two months the usual commercial term. There is no general statutory tenant notice period that overrides the contract, so read the termination clause and count from the date the notice is actually delivered.
Only if the landlord agrees or the agreement permits it. The deposit secures damage and dues, and many agreements expressly bar adjusting it against rent, so pay the final rent separately and ask for the deposit back on handover.
Under Section 11 of the Model Tenancy Act, 2021 the deposit is returned at the time of taking over vacant possession of the premises, after deducting any liability of the tenant. Section 11(1) also caps it at two months' rent for a home and six months' rent for a shop or office.
