The Data Correction Request Letter Generator builds a rectification request that names each inaccurate field, the value currently on file, the correct value and the supporting evidence, then calculates the exact date the organisation must reply by. It applies the real response periods: one calendar month under GDPR Art. 12(3), extendable by two further months, and 45 calendar days under Cal. Civ. Code s.1798.130(a)(2), extendable once by 45. Under GDPR and UK GDPR Art. 12(3) the controller must act without undue delay and in any event within one calendar month of receiving the request, extendable by up to two further months where the request is complex — but it must tell you about the extension inside that first month. In California the deadline is 45 calendar days, extendable once by another 45 with notice.
No. GDPR Art. 12(5) makes responses free of charge, and a fee may only be levied where a request is manifestly unfounded or excessive, which the controller has to prove. In California the first two requests in a twelve-month period are free. Refusing to act without payment is not an option open to the organisation.
It must tell you why and inform you of your right to complain to a supervisory authority and to seek a judicial remedy, under GDPR Art. 12(4), within the same one-month window. If you disagree with the refusal you can escalate to the regulator — the ICO in the UK, your national data protection authority in the EU, or the Data Protection Board of India under the DPDP Act, 2023.
Not formally, but it helps. A controller is entitled to satisfy itself that a new value is accurate before overwriting its record, and under California's CCPA Regulations s.7023 it may weigh documentary evidence on both sides.
